3Commission plans, reports and payments
- 3.1Once You join the Affiliate Program, Your Account is set to Our standard Remuneration Plan unless otherwise agreed between the parties in the Insertion Order. The standard Remuneration Plan is a Net Revenue Share percentage determined by the number of Customers referred by the Affiliate within one month, calculated in accordance with the rules published at www.sturmpartners.com/commission.
- 3.2If the total Affiliate Fees owed to You for any calendar month are less than 500 €, the balance is carried over to the following month until the total reaches 500 € or more. You are not required to refer a minimum number of new active Customers in any calendar month to be eligible for a withdrawal of Affiliate Fees.
- 3.3All payments are due and payable in euros. Affiliate Fees are paid by bank transfer or in crypto, as selected by You in Your affiliate account, with a minimum payout of 500 € for either method. You are responsible for keeping Your payment details up to date at all times. Any charges connected with transferring the Affiliate Fees to You are borne by You and deducted from Your Affiliate Fees. We have no liability for currency conversion charges or charges associated with transfers to Your bank account.
- 3.4Unless otherwise agreed, and subject to this Agreement and Your full compliance with it, Affiliate Fees are paid on a calendar-month basis, within 20 days of receipt of Your invoice, after any deductions or set-offs We are entitled to make. Invoices are addressed to AMATO ANGELESKI LTD (VAT no. BG205550410), sent to affiliates@sturmpartners.com between the 5th and the 15th of the following month and state Your affiliate ID, the month and year, the exact commission amount and Your company details with VAT or registration number.
- 3.5Neither You nor Your friends, employees, agents, advisers or relatives may become Customers through Your Tracking links. If they do, You are not eligible for the relevant Affiliate Fees and must inform Us. "Relative" means a spouse, partner, parent, child or sibling. The number of Customers per individual household computer is strictly limited to one. You shall not register as a Customer or make deposits (directly or indirectly) through Your Tracking links for Your own personal use or that of Your relatives, friends, employees, agents or advisers. Customers who register using a VPN or proxy server, or who share the same IP pool, are not credited towards affiliate earnings. Violation of this provision entitles Us to terminate this Agreement and to withhold and seize indefinitely all Affiliate Fees owed to You at that time.
- 3.6The calculation of Your Affiliate Fees is final and authoritative and not open to review or discussion. We make the relevant figures available to You through the affiliate platform. To allow accurate tracking, reporting and allocation of Affiliate Fees, You must ensure that Tracking links are properly formatted throughout the term of this Agreement.
- 3.7We reserve the right to review all Affiliate Fees for possible fraud, whether on the Customer's side or on Yours. During such review, which shall not exceed 180 days, We may withhold any Affiliate Fees generated in Your Account until the review is concluded, subject to its conclusions. Any fraud on Your side is a breach of this Agreement, and We may terminate it immediately. Where We deem that fraud has occurred, either on Your part or on the part of a Customer, You are not entitled to any Affiliate Fees generated in Your Account at that time. We may offset any amounts already paid to You that are shown to have been generated by fraud against future Affiliate Fees.
- 3.8For the purposes of this Agreement, fraud includes, without limitation:
- 3.8.1actual or attempted bonus abuse by a Customer;
- 3.8.2encouragement of bonus abuse by You or any third party;
- 3.8.3a chargeback by a Customer in relation to a deposit;
- 3.8.4collusion between Customers;
- 3.8.5the opening of an Account in breach of this Agreement;
- 3.8.6the offering or provision of Spam Traffic to Potential Customers by You or any third party;
- 3.8.7any attempt by You to artificially increase the Affiliate Fees payable to You;
- 3.8.8deposits, revenues or traffic generated through illegal means;
- 3.8.9any other act by You or a Customer committed in bad faith against Us or to defraud Us (as determined by Us in Our sole discretion), whether or not it has caused harm, including deposits made with stolen cards, collusion, manipulation of the service or system, bonus or promotional abuse, and unauthorised use of third-party accounts, copyrights, trade marks or other intellectual property (including Ours);
- 3.8.10any attempt to register or use domain names confusingly similar to Ours, containing all or part of Our domain names, including any alteration such as letter replacement.
- 3.9Potential Customers must arrive through Your Tracking link for You to receive Affiliate Fees when they become Customers. We are not liable for Your failure to use Tracking links, or for any miscalculation or other damage resulting from it. We may amend Our tracking system and reporting format at any time and at Our sole discretion, with notice to You.
- 3.10If You disagree with a monthly report or the amount payable, You should not accept the payment and must send Us a reasoned objection in writing within ten (10) days of the report being made available; otherwise Your right to dispute the report or payment is waived. Acceptance of a payment constitutes complete and final settlement of the Affiliate Fees for that month. If any overpayment is made by mistake or through a calculation error, We may correct it at any time and reclaim, deduct or withhold the overpaid amount.
- 3.11You shall comply at all times with all applicable laws and any policy We notify to You regarding money laundering and the proceeds of crime.
- 3.12All taxes due on payments to You are Your sole liability. You are solely responsible for registering for and paying all direct and indirect taxes, including VAT, levies, duties, income tax and other charges on Your income under this Agreement, and for any income tax and social security contributions for Yourself and Your staff. We will not increase the Affiliate Fees on account of any tax, levy, duty or charge (including VAT); all Affiliate Fees are inclusive of such amounts.
- 3.13In cases of suspected affiliate fraud, Sturmpartners reserves the right to request identification documents.
- 3.14You are not entitled to Affiliate Fees for Customers who have closed, suspended or otherwise terminated their Account for reasons related to problem gambling, gambling addiction or responsible-gambling self-exclusion (as determined by Us in Our sole discretion). Such Customers are excluded from the calculation of Affiliate Fees.
- 3.15If You are inactive and fail to refer any First Time Depositors (FTDs), We may reduce Your commission to a flat rate of 25% until You refer 5 FTDs within a 30-day period. Once You do so, Your commission reverts to the original deal.
- 3.16We may terminate any affiliate account if the Affiliate does not log in or respond to Us within 90 days after We have notified the Affiliate by e-mail that it has become an inactive Affiliate.
- 3.17Any player deemed by the Company to be fraudulent or a bonus abuser, who self-excludes, voluntarily closes their account, or who duplicates an existing account, does not qualify for a Cost Per Acquisition (CPA) payment.
- 3.18Where a chargeback is received against a Customer, or credit is issued to a Customer, the Affiliate is not eligible for the CPA payment for that player. We reserve the right to change the commission payment schedule and payment methods at any time.
4Personal data
- 4.1We may process Your personal data, including but not limited to e-mail addresses, transaction details, IP addresses, Your name and surname and the names of Your employees, where applicable.
- 4.2Our Privacy Policy, published at www.sturmpartners.com/privacy-policy, forms an integral part of this Agreement. It explains how personal data is processed and applies to the use of the site; it includes Our Cookie Policy. By using the site You consent to such processing and warrant that all data You provide is accurate.
5Electronic marketing rules and spam traffic
- 5.1You represent and warrant that all e-mail, SMS and other direct marketing communications and activities ("Direct Marketing Communications") comply with this Section 5 when You promote the Website through these channels.
- 5.2You are solely responsible for ensuring that all Direct Marketing Communications comply with applicable laws.
- 5.3Each Direct Marketing Communication must meet the following requirements:
- 5.3.1it makes clear and unambiguous that it advertises the Website;
- 5.3.2promotional offers, competitions or games are clearly identified, with all qualifying conditions stated unambiguously;
- 5.3.3it is not sent to any person under 18 or under the legal age of consent in the recipient's country, whichever is higher;
- 5.3.4it promotes only the Website, using exclusively the Marketing Materials We provide, without third-party content;
- 5.3.5it shows a true name in the "From" field, not a sales pitch or marketing message; You clearly identify yourself as the sender and do not falsify Your identity or suggest that the message comes from the Company;
- 5.3.6it does not mislead recipients about its content or purpose, and provides a functioning, clearly visible opt-out or unsubscribe method;
- 5.3.7it includes a valid e-mail address to which the recipient can reply to opt out of future communications, which remains active for at least 30 days after sending, and a physical business address;
- 5.3.8opt-out and unsubscribe requests are handled within a reasonable time, and You stop sending marketing communications to anyone who has asked not to receive them;
- 5.3.9it includes a link to Your privacy policy;
- 5.3.10it is not sent to any person registered on any register of persons who do not wish to receive marketing communications.
- 5.4Affiliates running their own e-mail and SMS campaigns for the Sturmplay brand must comply with the e-mail guidelines provided by Sturmpartners. All such campaigns must include a valid, functioning unsubscribe link.
- 5.5You must suppress Your mailing lists to exclude persons who have self-excluded from gambling or who should otherwise not receive marketing for the Sturmplay brand. You are solely responsible for ensuring that self-excluded persons do not receive promotions after their self-exclusion.
- 5.6You must promptly notify the Company of any communication or complaint You receive from a recipient of a Direct Marketing Communication about Your marketing activities or about GDPR matters.
- 5.7If the Company receives complaints from recipients or competent authorities about Your communications, practices or GDPR compliance, You may be required to provide full information about the recipient, including the data source and proof of opt-in consent. You agree to respond within 5 days of such a request.
- 5.8You authorise Us to provide information about You, as the data controller solely responsible for GDPR compliance in processing the personal data of recipients of Your Direct Marketing Communications, together with Your reply to any request under the preceding clause, to any person who has filed a complaint with Us and to any competent authority.
- 5.9You shall not artificially increase profits or defraud the Company through incentivised traffic, cashback traffic or Spam Traffic. Violation results in forfeiture of all profits from the affected Accounts and termination of Your Account. Traffic is considered 100% incentivised where customers are instructed to deposit specific amounts that trigger CPA deals, for example through messages such as "cheat the casino online", "make money online" or "beat the casino online". In such cases Your affiliate account is submitted for inspection by Our fraud team, and CPA conditions are automatically upgraded to a 200% wagering requirement.
- 5.10Every promotional campaign must include the following: "18+", "T&Cs apply" and "Gambling can be addictive. Play responsibly", together with a link to a recognised responsible-gambling organisation for the targeted market (for example BeGambleAware.org).

If a particular Tracking link is terminated, You no longer receive Affiliate Fees from that link unless otherwise agreed.
- 6.4The Company may temporarily suspend this Agreement in whole or in part at its sole discretion, without limiting its other rights and remedies. Affiliate Fees generated through affected Tracking links may be withheld during the suspension and are paid within 30 days of the suspension being lifted.

- 7.1We make no warranties or commitments (whether express or implied by law, legislation or otherwise) regarding the Affiliate Program, the Website or any content, products or services available in or connected to it, nor that the Website, Our infrastructure, network, software or hardware (or those provided to Us by third parties) will be error-free or uninterrupted. All representations, warranties and implied terms are excluded to the fullest extent permitted by law. The Company and its suppliers are not required to maintain redundant systems, networks, software or hardware.

- 7.5Without prejudice to any other right or remedy, We may set off any payment due from Us to You under this Agreement against any liability You have to Us, including any claim We have against You arising from Your breach of this Agreement.
- 7.6Affiliate actions and marketing activities that breach this Agreement may result in serious consequences, including termination of the account, fines and possible civil and criminal proceedings.
